Megillah 31b:4ืžื’ื™ืœื” ืœืดื ื‘:ื“ืณ

And with regard to Abraham it is written: โ€œAnd he said, O Lord God, by what shall I know that I shall inherit it?โ€ (Genesis 15:8). Abraham said before the Holy One, Blessed be He: Master of the Universe, perhaps, Heaven forbid, the Jewish people will sin before You, and You will do to them as You did to the generation of the Flood and as You did to the generation of the Dispersion, i.e., You will completely destroy them? God said to him: No, I will not do that.

But Moses said to ื™ื”ื•ื”, โ€œPlease, O my lord, I have never been a man of words, either in times past or now that You have spoken to Your servant; I am slow of speech and slow of tongue.โ€

Exodus 4:14ืฉืžื•ืช ื“ืณ:ื™ืดื“

ื™ื”ื•ื” became angry with Moses and said, โ€œThere is your brother Aaron the Levite. He, I know, speaks readily. Even now he is setting out to meet you, and he will be happy to see you.

ื’ื ืžืชืžื•ืœ ื•ื’ื•ืณ NEITHER FROM YESTERDAY [NOR FROM BEFORE YESTERDAY] โ€” This teaches us that for an entire period of seven days God had been endeavouring to persuade Moses at the thornbush to go on his mission, for the terms ืžืชืžื•ืœ and ืฉืœืฉื•ื and ืžืื– ื“ื‘ืจืš imply three days, and the three-fold ื’ื which is mentioned here point to three extensions of the period, making six in all, and therefore he had now reached the seventh day when he further said to him, (Exodus v. 13) โ€œSend, I pray thee, by the hand of him whom Thou wilt sendโ€ โ€” until God became angry with him (Exodus v. 14), and he accepted the mission (cf. Leviticus Rabbah 11:6, and Seder Olam ch. 5). All this reluctance was because he was unwilling to assume any dignity that would make him superior to his brother Aaron who was older than he and was also a prophet, as it is said (I Samuel 2:27) that the man of God spoke to Eli, the high-priest, in Godโ€™s name, โ€œSurely I revealed myself unto the house of thy father when they were in Egyptโ€ โ€” thy father means Aaron. Similary in : (Ezekiel 20:5, 7) โ€œAnd I made myself known unto them in the land of Egypt โ€ฆ and I said unto them, โ€œcast ye away every man the detestable things of his eyesโ€, and that prophecy was spoken to Aaron (Exodus Rabbah 3:16; and cf. ื‘ืจื™ื™ืชื ื“ืœ"ื‘ ืžื“ื•ืช).

A deaf person that can speak but not hear, or hear but not speak, they are like hearing/speaking people and can be included. But if he is deaf and mute, he is treated like a mentally incompetent person or a minor.

A minor that has reached the age of understanding that he is praying to God can be included for the zimun for 3 and 10. Some say that a child cannot be included in a zimun until he reaches the age of thirteen and then he is assumed to be an adult who has produced two hairs. (Rosh and Mordechai Perek Shlosha Sheachlu and Tur) This is the custom and one should not deviate from it. Someone deaf or insane may be included in a zimun if he can concentrate and focus even though the deaf person cannot hear the beracha (Mahril)

like the actions of a forewarned ox that gored an ox, a donkey, and a camel. Since this ox gored three different animals on three separate occasions, it is considered predisposed to gore and becomes forewarned for every type of animal. Likewise, if someone performs three different deranged actions, it is assumed that there is no logical reason for his behavior and he is classified as an imbecile. Rav Pappa said: If Rav Huna had heard that which is taught in a baraita: Who is an imbecile? This is one who destroys whatever is given to him, he would have retracted his statement that one is an imbecile only if he performs three deranged actions.

Chagigah 3b:12ื—ื’ื™ื’ื” ื’ืณ ื‘:ื™ืดื‘

ยง The Sages taught: Who is considered an imbecile? One who goes out alone at night, and one who sleeps in a cemetery, and one who rends his garment. It was stated that Rav Huna said: One does not have the halakhic status of an imbecile until there are all of these signs present in him at the same time. Rabbi Yoแธฅanan said: He is considered an imbecile even due to the appearance of one of these signs.

Shulchan Arukh, Yoreh De'ah 1:5ืฉื•ืœื—ืŸ ืขืจื•ืš, ื™ื•ืจื” ื“ืขื” ืืณ:ื”ืณ

A person who is mute: that does not speak and does not hear; and a mentally disabled person, which is one who goes out himself at night or rips his clothes or sleeps in a graveyard or losses what is given to himโ€ฆ even just one of these, if he does it in the way of a crazy person; and a minor who does not know how to train his hands to shecht; we do not let them shecht lehatโ€™hila (initially). Even if others are standing over them. And if they (none the less) shechted, their shechita is kosher if others were standing over them. But we do not allow them to shecht lehatโ€™hila when others are not stand standing over them, even if we want to feed (the meat) to dogs. If a minor knows how to train his hands, if others are standing over him, he can shecht lehatโ€™hila and it is allowed to eat from his shechita. Rema: However, if he shechts for himself, than his shechita is disqualified, even if he knows the laws of shechita; he is considered a minor with regards to this matter (of shechita) until he has become bar-mitzvah, which is 13 years and 1 day [old]. There are those that are strict to not give kabalah to anybody less than 18 years old. For then he is a โ€œman with wisdomโ€, and knows to be careful.

Paragraph 9- ื”ื ื›ืคื” (One who often collapses from a disease that drives him out of his mind), is disqualified from testifying while collapsed, but is valid while healthy. This is true whether he collapses from time to time or consistently collapses without any set time, so long as his senses are not always distorted because there are those that often collapse and are out of their mind even while healthy. We must extensively evaluate the testimony of one who collapses often.

Paragraph 8- One who is insane is disqualified from testifying. An insane person is not just someone who walks around naked, breaks vessels and throws stones, (rather) it is anyone who goes out of his mind and his senses are consistently lacking on any matter, even though he can speak and act appropriately on other matters. Such a person is disqualified from testifying and is included in the category of the insane.
